CBSE in turn said that it had already made preparations to conduct the exams and that the cancelation was made after the fact.
The Delhi High Court directed CBSE to take a call on whether to refund exam fees for Class 10 and 12 board exams as they were canceled this year.
The timeline to submit their decision has been set to 8 weeks.
The Appeal
Justice Prateek Jalan made the directive after hearing the petition filed by Deepa Joseph, mother of a Class 10 student studying in a CBSE affiliated school, who had to pay Rs 2,100 as examination fee.
Joseph’s counsel said that since the board exams were canceled on account of the pandemic, at least a part of the exam fees should be refunded.
This is even more so as CBSE’s expenditure this year was reduced.
Counter-Appeal
CBSE in turn said that it had already made preparations to conduct the exams and that the cancelation was made after the fact.
It further argued that it was a self-financing institution in that it doesn’t receive funds from the centre.
Its entire functioning is dependent on exam fees which it uses not only to conduct exams but also to maintain infrastructure, conduct deliberations and various events.
It also defended that there was no correlation between physically conducting the exams and the fees charged from students.
Historic Change In Board Exams And Results This Year
Class 12 board examinations were cancelled on June 1 after it was announced in April that CBSE Class 10 exams were cancelled.
For the first time in the history of board exams, results will be announced without conducting the exams.
The board said that it would determine the students’ results based on an alternative assessment method instead of regular evaluation.
The results will come out by the end of the month and will be posted on the board’s official website.
