For the 3rd time in row, Infosys decided not to follow Govt notice over the non-compete clause, and failed to turn up for the crucial meeting with Labour Commissioner and IT employee union.

What exactly is happening here?

Infosys Defies Govt Notice, 3rd Time In Row

Infosys was sent a notice by the Labor Commissioner for a meeting related to the non-compete clause that they have imposed on resigned employees.

But once again, no official from Infosys turned up at the meeting, where NITES was also present. 

The first time Infosys was sent a notice last month, they didn’t turn up, as they claimed that they didn’t get the grievance letter related to the issue.

Labour Commissioner again sent a notice for a meeting on May 17th, which was again ignored by Infosys as no official turned up.

After that, they were sent another notice for a meeting on May 26th, which was once again ignored.

Why is Infosys defying Govt notices, and refusing to meet the Labour Commissioner and NITES to resolve this issue?

NITES Reaction On This Fiasco

Reacting on this development, Harpreet Singh Saluja, President, Nascent Information Technology Employees Senate NITES said, “Infosys is mocking the notices issued by Central Government Labour Ministry as the management skipped today’s meeting as well. As Labour laws are in concurrent list of constitution the State Government have the appropriate powers to take decision in labour matters. The Central government though tried to hold joint discussion to resolve the issue amicably, but it seems Infosys management is stubborn and taking undue advantage of loopholes in Labour laws. IT sector employees are highly disappointed and are demotivated by the way interests and justice of IT Employees are being played with. However the fight for justice is still on. NITES will be pursuing the case further with State Government’s Labour Ministry till the time justice is not achieved.”

How Will Non-Compete Clause Issue Resolve?

As we reported in April, Infosys has placed a strict non-compete clause for resigned employees, wherein they are not allowed to work for 5 major competitors, in case they have the same client, and if the employee has worked for the client in the last one year.

These 5 companies for whom Infosys’ ex-employees are banned from working are: TCS, IBM, Accenture, Wipro and Cognizant.

After hundreds of resigned Infosys employees complained to NITES, one of the biggest IT Employees Union based in Maharashtra, they shot a letter to the Labour Commissioner, and Ministry of Labor to resolve this issue.

But it seems Infosys is delaying the meeting by refusing to follow Govt notice.
