In a sweeping update to U.S. immigration enforcement, the Department of Homeland Security (DHS) has implemented a Trump-era rule requiring all immigrants—including legal residents, workers, and students—to carry identification documents at all times.

This decision, effective April 11, marks the return of a long-dormant policy under the Alien Registration Act, as directed by the executive order “Protecting the American People Against Invasion” signed earlier this year.

Key Rules Under the New Policy

  • All non-citizens aged 18 and above must carry valid ID at all times and present it when asked by authorities.
  • Undocumented immigrants aged 14+ who have been in the U.S. for 30+ days must formally register by submitting Form G-325R.
  • Immigrant children must re-register and provide fingerprints within 30 days of turning 14.
  • New arrivals after April 11 must register within 30 days of entering the country.
  • Address changes must be reported to DHS within 10 days.
  • Non-compliance can lead to fines up to $5,000.

Who’s Exempt From Re-Registration?

Those already in the U.S. on valid documentation are not required to register again, including:

  • Green card holders
  • Visa holders (student, work, etc.)
  • Individuals with valid I-94 admission records

However, these individuals must still carry their documents at all times and show them when asked by authorities.

Impact on Indian Immigrants

According to DHS estimates, around 2.2 lakh Indians were living in the U.S. illegally in 2022. However, other organisations peg the number higher:

  • Pew Research Center: 7 lakh
  • Migration Policy Institute: ~3.75 lakh

While Indian nationals with valid visas are unaffected by the registration clause, they must remain compliant with the ID-carrying requirement.

Concerns & Criticism

This renewed regulation could have significant implications for undocumented communities, adding another layer of surveillance and legal risk. Civil rights groups have raised alarms about:

  • Privacy intrusions
  • Potential misuse of enforcement powers
  • Heightened fear and anxiety within immigrant communities

The DHS, however, maintains that the policy is essential for national security and that enforcement will be strict and immediate.

As the U.S. grapples with immigration reform, this move signals a more aggressive stance on documentation and monitoring—potentially setting the tone for future immigration policies.
