Major GST Relief For Employers

The GST Council has recommended allowing businesses to claim Input Tax Credit (ITC) on GST paid for group health and life insurance policies purchased for their employees. The decision, announced after the Council’s 57th meeting on October 8, 2026, could reduce the cost of providing employee insurance and potentially improve workplace benefits.

The recommendation involves amending Section 17(5) of the Central Goods and Services Tax Act, 2017, which previously restricted ITC claims on several categories, including employee insurance.

How Does Input Tax Credit Work?

Input Tax Credit allows a business to offset eligible GST paid on its purchases against the GST it owes on its own sales.

Previously, employers purchasing group health and life insurance for employees generally could not claim credit for the GST charged on those policies. This made the tax an additional business expense.

Under the proposed change, eligible employers will be able to claim the insurance-related GST as ITC, subject to applicable conditions and implementation rules.

Example: How Much Can A Company Save?

Consider a company that pays Rs 1 lakh as the premium for an employee group insurance policy. If 18% GST applies, the total cost becomes Rs 1.18 lakh.

Under the proposed framework, the company could claim the Rs 18,000 GST component as ITC, provided it meets the eligibility requirements and has sufficient output GST liability against which to use the credit.

This could reduce the effective insurance cost from Rs 1.18 lakh to Rs 1 lakh.

For companies providing insurance to hundreds or thousands of employees, the potential savings could be substantial.

How Will Employees Benefit?

The immediate beneficiary of ITC is the employer, not the employee directly. However, the lower cost could encourage companies to improve their insurance offerings.

Potential benefits include:

  • Higher insurance coverage: Employers may increase the sum insured under group health policies.
  • More comprehensive benefits: Companies could consider adding coverage options for employees and their families.
  • Wider insurance access: Small and medium-sized businesses may find group insurance more affordable.
  • Improved employee benefits: Employers could use the savings to strengthen their overall compensation packages.

These outcomes are possible rather than guaranteed. Companies may also choose to retain the savings for other business expenses.

Why Is This Change Important For Small Businesses?

Large corporations can often negotiate competitive insurance premiums because they cover large workforces. Smaller companies may have less bargaining power and tighter employee-benefit budgets.

Allowing ITC could reduce the effective cost of group insurance for eligible businesses, potentially making coverage more accessible to smaller employers.

The reform may also reduce the tax disparity between individual insurance policies and employer-sponsored coverage.

Is The Benefit Available Immediately?

The GST Council has recommended the amendment, but the recommendation should not be confused with the complete implementation of the revised rules.

Employers will need to follow the applicable legal provisions, notifications and conditions once the changes take effect. The ability to use ITC will also depend on the employer’s GST position and eligibility.

Employees should therefore not assume that their insurance premiums or coverage will automatically change.
