As per newest reports coming in, the rate rejection of the H-1B visas has now increased by as much as 37%!
This news comes days after the US Citizenship and Immigration Services (USCIS) issued a statement in which it stated that it was updating its policies regarding expedited processing of applications.
Also changing the guidance regarding Requests for Evidence (RFEs) and Notices of Intent to Deny (NOIDs), and increasing the validity period for certain.
H-1B Visa Rejection Rate Increases by 28%; Only 45% Applications Selected
As per reports, the USCIS was inviting the applications for H-1B visa applications for the financial year 2022. More than 3 lakh applications have been submitted but only a few of them have been selected.
The H-1B cap registration has received 3.08 lakh registrations for the financial year 2022. This is a 12% increase from last year’s filing. However, the USCIS has selected 87,500 registrations only in the lotteries that meet the annual quotas.
As per reports, there has been a decline in the selection rate of the H-1B visa. This decline has increased by 28% as compared to last year. Additionally, there were 274,237 total registrations, of which, only 45% of the applications, i.e., 12,415 registrations were selected.
Rejection Increases Despite US Government’s New Rules?
Recently, there was news that the Biden administration is willing to reconsider the objections or adverse decisions to foreign workers on visas like H-1B as informed by US Citizenship and Immigration Services (USCIS) on Friday. This was due to the three policy memos by the previous Trump administration which now have been rescinded.
The move is expected to provide relief to a large number of Indian IT professionals, since they were having a tough time dealing with the various policies and memorandums on non-immigrant work visas, in particular H-1B from the previous Trump administration.
Recently, there also was news that a rule proposed by former President Donald Trump’s administration to restrict the scope of “speciality occupation” under the H-1B visa regime has been withdrawn by the US government.
The move is extremely positive for Indian IT companies, which are among the most frequent users of such visas.
Generally, USCIS replaces the withdrawn, rejected, denied, or revoked applications by selecting more candidates. The new method for the selection has lowered the selection count.
