Iconic Burger King From Pune Wins 13-Year Court Battle Against US-Based Burger King

In a landmark legal victory, Pune’s locally-owned Burger King has successfully defended its right to continue operating under the “Burger King” name, despite a lengthy battle with the U.S.-based Burger King Corporation. The decision, handed down by District Judge Sunil Vedpathak, marks the end of a 13-year dispute that began in 2009.

The Origins of the Dispute

The conflict started when the U.S.-based Burger King Corporation, represented by Pankaj Pahuja, filed a lawsuit against Anahita and Shapoor Irani, owners of the Pune-based M/s Burger King, which operates in the Koregaon Park and Camp areas. The American fast-food giant sought to prevent the Pune restaurant from using the “Burger King” trademark, alleging trademark infringement and demanding damages, as well as a permanent ban on the use of the name.

The American company, founded in 1954, has expanded globally and entered the Indian market in 2014. However, they discovered that a restaurant in Pune had been operating under the same name since 1992-1993. The American corporation issued a cease-and-desist notice in 2009, offering an amicable settlement, but the Pune-based Burger King refused to comply, leading to a prolonged court battle.

The Court’s Ruling

Judge Vedpathak ruled in favor of the Pune-based Burger King, emphasizing that the restaurant had been using the “Burger King” name for over two decades before the American corporation registered its trademark in India. The judge noted that the U.S. company had not used the trademark in India for nearly 30 years, during which time the Pune restaurant had consistently operated under the name, providing legal and honest services.

The court’s decision highlighted the significance of the continuous and reliable service provided by Pune’s Burger King. The effective arguments presented by the restaurant’s legal team, including Advocates AD Sarawte, Srishti Angane, and Rahul Pardeshi, played a crucial role in securing this victory.

This ruling is not only a win for Pune’s Burger King but also a significant precedent for local businesses facing challenges from global corporations. The decision ensures that this iconic Pune eatery can continue serving its loyal customers, preserving its legacy and reputation in the local community.
