Canada Fights Immigration Frauds By Making Tough Rules: Points To Be Removed Under LMIA & More

Canada’s immigration authorities are considering significant reforms to curb fraudulent activities tied to the Labour Market Impact Assessment (LMIA) process. This development could reshape the path to permanent residency (PR), particularly for applicants relying on job offers to boost their scores under the Express Entry system.

What is LMIA, and Why Does It Matter?

The LMIA is a document Canadian employers must obtain to hire foreign workers. It ensures that hiring an international candidate does not negatively impact the local labor market. Under the current system, applicants for PR with a valid LMIA-backed job offer can gain an additional 50 points or more, significantly increasing their chances of qualifying for PR through the Express Entry stream.

However, this advantage has inadvertently spurred fraudulent practices, with anecdotal evidence of job offers being sold for exorbitant fees, ranging from CA$10,000 to CA$75,000.

Proposed Changes: Eliminating LMIA Points

Canadian Immigration Minister Marc Miller announced the government’s plan to introduce measures to “reinforce programme integrity and reduce LMIA fraud.” One of the major proposals involves removing the additional points awarded to Express Entry candidates for LMIA-backed job offers.

“This measure is expected to remove the incentive for candidates to purchase an LMIA, resulting in increased fairness and integrity in the system,” Miller stated during a press conference in Ottawa.

Why the Change is Necessary

Fraudulent LMIAs have become a widespread issue, with some unscrupulous immigration agents allegedly collaborating with employers to exploit the system. Social media platforms have even seen blatant advertisements for LMIA sales.

Immigration analyst Darshan Maharaja remarked, “The removal of points for LMIAs will begin to undo this serious damage by eliminating the incentive to buy it to secure permanent residency in Canada. However, it should be noted that the enormity of this damage is such that it would be prudent to keep expectations in check.”

Implications for Genuine Applicants and Employers

While the proposed changes aim to tackle fraud, they may have unintended consequences for genuine applicants and employers who rely on LMIA-backed job offers to meet Canada’s skilled labor demands.

Naresh Chavda, president of Globayan Immigration Corporation, voiced concerns, saying, “There are thousands of genuine LMIA workers who are highly skilled or have unique skillsets in demand in Canada. They and their employers could suffer due to this decision, with its ramifications for the country’s economy. To prevent fraud, the Government of Canada needs to improve the screening process and other measures, not cut the LMIA category for Express Entry fully.”

The Bigger Picture: Impact on Immigration and Economy

The Canadian government’s stance reflects its broader efforts to regulate immigration while maintaining economic stability. According to reports, nearly 71,300 LMIAs were approved in the first quarter of 2024, up from 63,300 during the same period in 2023.

For many, the LMIA advantage is not just a loophole but a lifeline. Removing it entirely could slow down the influx of skilled workers, potentially affecting industries already grappling with labor shortages.

A Balancing Act for Canada

The proposed changes highlight the challenge of balancing immigration integrity with economic growth. As Immigration Minister Marc Miller put it, “The goal is to reinforce programme integrity without jeopardizing Canada’s need for skilled talent.”

Still, skepticism remains. “The government has given no time frame for the necessary legislative change,” noted Maharaja, adding that the initiative’s success hinges on effective implementation.

What’s Next?

As of now, no definitive timeline has been provided for these legislative changes. For prospective immigrants and employers, this uncertainty means adapting to evolving policies while keeping an eye on future announcements.

Canada’s immigration reforms reflect its commitment to maintaining a fair and transparent system. Whether these measures can successfully curb LMIA fraud without unintended fallout remains to be seen.
