In a huge setback to India’s 3rd biggest IT company: HCL, the Labour Ministry has sent a notice regarding recovery of bonus amount from employees.
We have read the letter, and it also mentions the date when HCL management needs to meet the Labour Ministry regarding this issue.
The notice to HCL was sent after the IT Employees Union: Nascent Information Technology Employees Senate NITES raised this issue with the Labour Ministry.

Labour Ministry Issues Notice To HCL
Labour Ministry under Govt of India has asked HCL Management to meet Pune’s Labour Commissioner on February 17th, 2022 at 12.30PM.
This notice has been issued to HCL over their recovery tactics of bonus amount already paid to the employees.
HCL has recovered on an average Rs 1-Rs 1.2 lakh from thousands of employees, who had resigned.
Commenting on this development, Harpreet Saluja, President, Nascent Information Technology Employees Senate NITES said, “Labour Ministry sends notice to HCL Technologies Ltd. on NITES complaint.
Strengthening our fight against illegal bonus recovery policy of HCL Technologies Ltd. the Labour Ministry has send an official notice to HCL Technologies Ltd. The company has been called upon at the Labour commissioner office Pune on 17th February 2022 at 12:30 PM.
NITES has been rigorously pursuing the case to provide justice to employees of HCL Technologies Ltd from whom the company has illegally recovered bonus amounts. The average bonus amount per employee is nearly 120000. In these testing time of Covid-19 pandemic it has become very difficult for the employees to pay amount back to the company. HCL Technologies Ltd has also send legal notice to employees for recovery of amounts as well. We will keep striving hard until we get justice for all the HCL Technologies Ltd employees.”
HCL’s Modus Operandi: The Story So Far..
Last month, we reported that HCL has started ‘recovering’ the advanced bonus that was paid to the employees. The recovery was being done from those employees, who had resigned from HCL.
Since the bonus was already paid in the salary, returning the same was unjustified.
Soon, HCL started threatening that they won’t issue experience certificate to the employees, in case the advanced bonus is not paid, and this was plain blackmailing. However, HCL justified this action.
HCL Has Stopped Recovering The Bonus
After the employees raised this issue, and objected to this arm-twisting method of HCL, they have stopped recovering the bonuses paid to the employees.
Recovery of both types of bonuses: EPB (Engagement Performance Bonus) and AMPB (Advance Monthly Performance Bonus) have been stopped now.
However, the employees who have already paid back the bonus to HCL are at their receiving end, since HCL is refusing to pay them back.
It’s expected that there are thousands of HCL employees, who have paid on an average Rs 1-Rs 1.2 lakh back to HCL.
