OYO Directed To Pay Rs. 1.61 Lakh As Compensation For Deficiency In Service

The Pune district consumer disputes redressal commission has now ordered OYO Total Holidays to pay Rs. 1.61 lakh as compensation for being deficient in service.

Atul Kulkarni, a resident of Vadgaon Budruk, Pune, had filed a complaint against the OYO Hotels and Homes with the consumer forum about his trip to Kerala last year.

A consumer complaint has been filed under Section 12 of the Consumer Protection Act, 1986. The complainant has sought monetary relief against OYO for adoption of unfair trade practices and consequential deficiency in service.

As per the complaint, the complainant had booked an ‘Amazing Kerala’ tour with Oyo Total Holidays. He had paid a total consideration of ?1,38,500 for 11 passengers at the rate of ?12,590 per person.

Under these charges, breakfast, accommodation, all transfers and sight-seeing by private vehicle, and pick-up and drop from Kochi airport and the railway station were offered to the customer.

What Is The Complaint About?

The grievance of the complainant is not about the sight-seeing; it is about the transport facility and accommodation.

The Pune district consumer disputes redressal commission has stated that in sum and substance the case of the complainant is that the company failed to arrange any vehicle for 11 people. The complainant had to arrange for a private vehicle, therefore, and the expense for the same was borne by him.

Additionally, the room accommodation at Munnar was not arranged as promised. The complainant had to pay Rs. 6,134 extra while leaving the room on December 27, 2019. The total expenditure that was incurred by the complainant was Rs. 51,134. This money was paid by the complainant in addition to the tour charges that was already paid.

A refund has been demanded by the complainant from the company; and when the company failed to offer the refund despite accepting to pay it, the complainant went to consumer forum.
