The Dutch multinational company Philips has filed a restraining order on the Chinese smartphone manufacturer Xiaomi Inc. in the Delhi High Court.

Philips alleges Xiaomi of infringing or breaching three different patents related to the Universal Mobile Telecommunications Service or UMTS enhancements, which has been listed in detail, further in the article.

The Dutch company has also sought for an ‘ad-interim injunction’ order in the Delhi HC, to prohibit Xiaomi, its affiliates and officers/agents from selling any Xiaomi products/smartphones in India, for the time being.

Philip Sues Xiaomi on Violating 3 Patents 

The Dutch conglomerate Philips had moved to the Delhi High Court, alleging Xiaomi Inc. of violating 3 technology patents, thereby restraining the Chinese smartphone maker from selling its products in India.

It sought a restraint on:

manufacturing or assembling, importing, selling, offering for sale, advertising including through their and third party websites, its mobile phones and devices that include UMTS enhancement (HSPA, HSPA+) and LTE technologies, thereby violating the company’s patents.

Philips India also wants an “ad-interim order of injunction” be granted, directing the Central Board of Excise and Customs to issue appropriate instructions to customs authorities at every port, including airports in India to not allow the import of Xiaomi’s mobile handsets in the country.

Delhi HC Moves Order in Favor of Philips

The Delhi HC has passed the order in favour of Philips India and has directed Xiaomi Inc and other defendants to maintain an amount of Rs 1,000 crore in their bank accounts until the next hearing date.

It has also demanded Xiaomi to file the details of its bank accounts in India where the amount of ?1,000 crore is being maintained, on or before 2 December 2020.
