As per the reports, A criminal complaint has been filed against an Uttrakhand firm, Baba Ramdev and Patanjali Ayurveda Limited,, at the Chandigarh District Court.
Further, ther registration of a case of alleged sale of adulterated drugs and attempt to murder under the Indian Penal Code (IPC), and further under the Section of the Drugs and Magic Remedies Act.
Why Would This Happen?
Earlier, a First Information Report (FIR) has been filed at Jyoti Nagar police station in Jaipur against Baba Ramdev, his aide and the chief executive officer (CEO) of Patanjali Ayurved, Acharya Balkrishna, and three others for allegedly making deceiving claims about the herbal medicine Coronil, that company has found a cure for the disastrous coronavirus disease (Covid-19).
According to additional deputy commissioner of police (DCP), south, Jaipur, Avnish Parashar, on the basis of the FIR lodged by Balbir Jakhar, Ramdev, Acharya Balkrishna, Dr. Balbir Singh Tomar, Dr. Anurag Tomar and Anurag Varshney, have been booked under Section 420 (cheating) of the Indian Penal Code and relevant sections of the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954.
Further, advocate Jakhar said, “The accused have put the life of common people at risk. Neither the Rajasthan government nor the Centre was informed about the clinical trials about Coronil,”.
Out of these five accused, Dr. Balbir Singh Tomar and Dr. Anurag Tomar, are the chairman and the director, respectively of the Jaipur-based NIMS University.
On the other hand, fifth accused, Varshney, is a scientist at Patanjali Ayurved.
The Chandigarh complaint has been filed by General Secretary of National Consumer Welfare Council at Chandigarh, Bikramjit Singh.
He filed a complaint, seeking a case against Baba Ramdev and the Patanjali Ayurved Limited, under the Sections 275 (sale of adulterated drugs), 276 (sale of drug as a different drug or preparation), 468 (Forgery for purpose of cheating), and 307 (attempt to murder) of Indian Penal Code, and section 4 of Drugs and Magic Remedies (Objectionable Advertisement) Act, 1954.
On Monday, the matter will be heard in the Chandigarh Court.
Mr Singh said in the complaint that medical products, tablets, pills and capsules having medicine for diseases and for human consumption cannot be advertised without prior permission from the authority appointed by the government.
Normally, the permission is granted only after the medical council and authorities inspect the quality and genuineness of the medicines.
What Does The Ministry Say?
Prior to this, the Patanjali Ayurved has launched Coronil tablet and Swasari vati medicine that claims to cure the Covid-19 within seven days.
Further, the Ayurvedic medicine company has claimed that the two Ayurveda-based medicines have given 100% favourable results during clinical trials on Covid-19 patients except those on a life support system.
On the other hand, the Union Ministry of Ayurveda, Yoga & Naturopathy, Unani, Siddha, and Homoeopathy (AYUSH) claimed that they were unaware of the Patanjali Ayurved’s claims.
Moving ahead, the ministry has sought the details of a report from the company about the composition, testing and other data of the drugs.
In the meantime, Patanjali Ayurved also has been asked to “stop advertising/publicising” the drug till the ministry verifies their claims.
