Indian Railways has lost its appeal against an order directing it to pay Rs 1.45 lakh to a passenger whose bag was stolen from a reserved train coach. The Delhi State Consumer Commission upheld the compensation order, holding Northern Railway responsible for negligence that allowed unauthorised people to enter the compartment.<\/p>\n\n\n\n The ruling reinforces the responsibility of railway authorities to maintain security in reserved coaches, particularly when theft occurs because of failures in preventing unauthorised access.<\/p>\n\n\n\n How Did The Theft Take Place?<\/strong><\/p>\n\n\n\n The case dates back to June 7, 2014, when Ajoy Kumar was travelling from Delhi to Patna in a reserved compartment of the Mahananda Express.<\/p>\n\n\n\n According to the case records, two unauthorised persons entered the coach at Old Delhi railway station. After an argument over a seat, they fled with the passenger’s bag containing belongings valued at approximately Rs 1.20 lakh.<\/p>\n\n\n\n The passenger reported the incident to the train ticket examiner (TTE) and subsequently pursued the matter with railway authorities. An FIR was eventually registered in April 2015, but the case was declared untraced in May 2017.<\/p>\n\n\n\n Unable to recover his belongings, the passenger approached the consumer commission seeking compensation.<\/p>\n\n\n\n Why Did The Railway Lose Its Appeal?<\/strong><\/p>\n\n\n\n Northern Railway argued that it could not be held responsible for the theft because the passenger’s luggage was in his personal custody and had not been booked as railway luggage.<\/p>\n\n\n\n However, the Delhi State Consumer Commission rejected this argument in its October 2026 decision.<\/p>\n\n\n\n The commission observed that the issue was not simply that a theft had occurred.
