It is an important step in the employment-based green card process for many foreign professionals.<\/p>\n\n\n\n<p>Under PERM, an employer generally must demonstrate that there are not enough qualified, available US workers for a particular position and that hiring a foreign worker will not adversely affect the wages and working conditions of American employees.<\/p>\n\n\n\n<p>The suspension means the government will not accept new PERM applications or process pending applications involving the eight companies while the restrictions remain in force.<\/p>\n\n\n\n<p><strong>How Will Indian IT Professionals Be Affected?<\/strong><\/p>\n\n\n\n<p>Indian technology professionals could be among the most affected because Indian nationals account for a substantial share of the US skilled-worker visa population.<\/p>\n\n\n\n<p>Employees whose employers have not yet completed the PERM stage may face delays in beginning or advancing their green card applications.<\/p>\n\n\n\n<p>The impact could be particularly serious for workers who are approaching the six-year limit on their H-1B visas. The allegations against the companies remain subject to investigation and should not be treated as established findings of wrongdoing.<\/p>\n\n\n\n<p><strong>What Should Indian Professionals Do Now?<\/strong><\/p>\n\n\n\n<p>Indian employees working in the US should check their individual immigration status and consult qualified immigration lawyers before making decisions about employment, travel or visa extensions.<\/p>\n\n\n\n<p>They should also ask their employers whether pending applications are affected and whether alternative routes may be available.
