The Union Cabinet has reportedly approved a proposal to amend the Prevention of Insults to National Honour Act, 1971, to make insulting or obstructing the singing of \u201cVande Mataram\u201d a punishable offence. The amendment is expected to give the national song legal protection similar to the national anthem, \u201cJana Gana Mana.\u201d<\/p>\n\n\n\n

According to reports, the proposal was cleared during a Cabinet meeting chaired<\/a> by Prime Minister Narendra Modi. Once enacted, any intentional disruption or insult during the rendition of \u201cVande Mataram\u201d could attract imprisonment of up to three years, a fine, or both.<\/p>\n\n\n\n

What Will Change Under The Law?<\/h2>\n\n\n\n

At present, Section 3 of the Prevention of Insults to National Honour Act applies mainly to the national anthem. The law currently punishes anyone who intentionally prevents the singing of the national anthem or causes disturbance during its rendition.<\/p>\n\n\n\n

The proposed amendment seeks to extend similar legal protection to \u201cVande Mataram,\u201d effectively placing the national song on par with the national anthem in matters of official respect and legal safeguards.<\/p>\n\n\n\n

Reports indicate that repeated offences may attract stricter punishment, similar to existing provisions under the Act.<\/p>\n\n\n\n

Why \u2018Vande Mataram\u2019 Is Significant<\/h2>\n\n\n\n

\u201cVande Mataram\u201d was written by Bengali novelist and poet Bankim Chandra Chatterjee and first appeared in his 1882 novel Anandamath<\/em>. The song became one of the most powerful slogans of India\u2019s freedom movement and was widely used during anti-British protests and nationalist gatherings.<\/p>\n\n\n\n

In 1950, India officially adopted \u201cJana Gana Mana\u201d as the national anthem, while \u201cVande Mataram\u201d was given the status of the national song and accorded equal respect.<\/p>\n\n\n\n

Debate Around The Song<\/h2>\n\n\n\n

Over the decades, \u201cVande Mataram\u201d has also remained politically and culturally sensitive. While the first two stanzas are widely accepted as patriotic and non-religious, later verses invoke Hindu goddesses like Durga and Lakshmi, leading to objections from some groups in the past.<\/p>\n\n\n\n

Because of these concerns, only the first two stanzas were officially adopted for public and national use during the freedom movement.<\/p>\n\n\n\n

Government\u2019s Recent Push Around \u2018Vande Mataram\u2019<\/h2>\n\n\n\n

The latest amendment proposal comes amid broader efforts by the Union government to increase the prominence of \u201cVande Mataram\u201d during official events. Earlier this year, the Ministry of Home Affairs reportedly issued instructions that all six stanzas of the song should be played at government functions marking its 150th anniversary celebrations.<\/p>\n\n\n\n

Reports also suggested that when both \u201cVande Mataram\u201d and \u201cJana Gana Mana\u201d are played at an event, the national song should be played first.<\/p>\n\n\n\n

Political Significance Of The Move<\/h2>\n\n\n\n

The Cabinet decision came shortly after the BJP\u2019s major victory in the 2026 West Bengal Assembly elections, where the party secured a historic win in the state associated closely with Bankim Chandra Chatterjee and the origins of \u201cVande Mataram.\u201d<\/p>\n\n\n\n

Supporters of the move say the amendment reinforces respect for national symbols and India\u2019s freedom movement legacy.
