In their complaint, they alleged multiple service deficiencies:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Broken and uncomfortable seats<\/strong> with malfunctioning controls and call buttons.<\/li>\n\n\n\n<li><strong>Inoperative in-flight entertainment systems.<\/strong><\/li>\n\n\n\n<li><strong>Unhygienic, foul-smelling washrooms.<\/strong><\/li>\n\n\n\n<li><strong>Poor quality food and beverages.<\/strong><\/li>\n\n\n\n<li><strong>Lack of response<\/strong> from the cabin crew despite repeated requests.<\/li>\n<\/ul>\n\n\n\n<p>The family provided <strong>photographic evidence<\/strong> showing the conditions onboard and had sent a legal notice to the airline before filing the complaint. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Consumer Court\u2019s Rationale<\/strong><\/h2>\n\n\n\n<p>The Commission held that paying passengers are <strong>\u201cconsumers\u201d<\/strong> under the <strong>Consumer Protection Act, 2019<\/strong> and that an airline is a <strong>\u201cservice provider.\u201d<\/strong> If an airline fails to provide services that are mandatory under the <strong>Directorate General of Civil Aviation (DGCA)<\/strong> standards \u2014 such as functional seating, sanitation, food quality, and attentive crew service \u2014 it amounts to a <strong>deficiency in service<\/strong>. Authorities emphasised passengers are entitled to compensation for <strong>mental agony and harassment<\/strong> when basic amenities are not provided despite payment for a premium service. <\/p>\n\n\n\n<p>In this case, the Commission found Air India\u2019s <strong>lack of rebuttal and failure to address documented concerns<\/strong> weakened its defence, leading to the award of compensation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Compensation Ordered<\/strong><\/h2>\n\n\n\n<p>The court directed Air India to pay the following to the complainants:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u20b950,000<\/strong> to the father for mental agony and harassment.<\/li>\n\n\n\n<li><strong>\u20b950,000<\/strong> to the daughter for similar distress.<\/li>\n\n\n\n<li><strong>\u20b950,000<\/strong> as litigation expenses.<\/li>\n<\/ul>\n\n\n\n<p>The plea for a <strong>full refund of ticket fare (~\u20b93.18 lakh)<\/strong> was rejected on the basis that the journey had been completed and the passengers chose to continue the flight. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Air India\u2019s Response and Broader Implications<\/strong><\/h2>\n\n\n\n<p>Air India denied the allegations, stating the aircraft had cleared routine checks and suggesting that the complaints first surfaced after the passengers\u2019 request for an upgrade was denied.
