Crucially, seed registration is not mandatory, allowing substandard varieties to enter the market easily.<\/p>\n\n\n\n<p>Penalties under the old law are outdated, with fines capped at just \u20b91,000 and imprisonment of up to six months, offering little deterrence against large-scale seed fraud.<\/p>\n\n\n\n<p>Past attempts to modernise the law, including a Bill introduced in 2004, never materialised. With nearly <strong><a href=\"https:\/\/indianexpress.com\/article\/explained\/higher-penalty-regulating-quality-for-sale-and-import-what-the-new-seeds-bill-proposes-10393339\/\">43,000 seed samples<\/a><\/strong> failing quality tests in the last three years, the demand for a stronger law had become urgent.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How Big Is India\u2019s Spurious Seeds Problem?<\/strong><\/h2>\n\n\n\n<p>Between 2022 and 2025, authorities tested nearly <strong>6 lakh seed samples<\/strong>, and <strong>43,001<\/strong> were found \u201cnon-standard\u201d. West Bengal alone accounted for 62% of these failed samples, followed by Tamil Nadu and Madhya Pradesh.<\/p>\n\n\n\n<p>Actions taken by states over the last three years include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>12,287 warnings<\/li>\n\n\n\n<li>12,915 stop-sale orders<\/li>\n\n\n\n<li>1,914 FIRs\/cases<\/li>\n\n\n\n<li>164 forfeitures<\/li>\n<\/ul>\n\n\n\n<p>With the Indian seed market valued at \u20b940,000 crore and annual need pegged at <strong>48.20 lakh tonnes<\/strong>, the presence of low-quality seeds deeply impacts crop yields and farmer livelihoods.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Provisions of the Seeds Bill, 2025<\/strong><\/h2>\n\n\n\n<p>The new draft legislation proposes:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1. Mandatory Registration of All Seed Varieties<\/strong><\/h3>\n\n\n\n<p>Only farmers\u2019 varieties and seeds meant solely for export are exempt. All others must be registered before sale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. Heavy Penalties for Violations<\/strong><\/h3>\n\n\n\n<p>Fines up to <strong>\u20b930 lakh<\/strong> and imprisonment up to <strong>three years<\/strong> for selling spurious or unregistered seeds.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3. Decriminalisation of Minor Offences<\/strong><\/h3>\n\n\n\n<p>While serious violations will attract strict action, minor ones will be treated more leniently.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. Quality Assurance &amp; Farmers\u2019 Protection<\/strong><\/h3>\n\n\n\n<p>The Bill aims to ensure farmers access reliable, high-quality seeds at fair prices and reduce losses from crop failure due to poor seeds.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5. Liberalised Seed Imports<\/strong><\/h3>\n\n\n\n<p>To provide access to high-performing global varieties while safeguarding farmers\u2019 rights.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Happens Next?<\/strong><\/h2>\n\n\n\n<p>The Agriculture Ministry has invited public feedback until <strong>December 11<\/strong>, after which the Bill will be reviewed by the Cabinet and introduced in Parliament.
