This new legislation proposes <strong>strict penalties<\/strong> \u2014 including <strong>up to 7 years of imprisonment<\/strong> and <strong>\u20b910 lakh in fines<\/strong> \u2014 for individuals found guilty of spreading fake news on <strong>social media platforms<\/strong>.<\/p>\n\n\n\n<p>The bill is expected to be presented before the next <strong>state cabinet meeting<\/strong>.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"574\" src=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/06\/Screenshot-2024-09-21-at-9.39.12\u202fAM-1024x574.png\" alt=\"Karnataka Proposes 7 Year Jail, Rs 10 Lakh Fine For Fake News\" class=\"wp-image-1296687\" srcset=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/06\/Screenshot-2024-09-21-at-9.39.12\u202fAM-1024x574.png 1024w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/06\/Screenshot-2024-09-21-at-9.39.12\u202fAM-300x168.png 300w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/06\/Screenshot-2024-09-21-at-9.39.12\u202fAM-768x430.png 768w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/06\/Screenshot-2024-09-21-at-9.39.12\u202fAM-1536x861.png 1536w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/06\/Screenshot-2024-09-21-at-9.39.12\u202fAM.png 1652w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Scope of the Proposed Punishment<\/h3>\n\n\n\n<p>Those who deliberately share <strong>false information<\/strong> that <a href=\"https:\/\/www.hindustantimes.com\/cities\/bengaluru-news\/karnataka-proposes-stringent-law-to-combat-fake-news-and-misinformation-on-social-media-7-year-jail-term-and-101750475383318.html\">threatens<\/a> <strong>public health, safety, peace<\/strong>, or the <strong>integrity of elections<\/strong> could face:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Up to 7 years in jail<\/strong><\/li>\n\n\n\n<li><strong>Fines up to \u20b910 lakh<\/strong><\/li>\n\n\n\n<li><strong>Both imprisonment and fine<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Even people <strong>outside Karnataka<\/strong> targeting users <strong>within the state<\/strong> with misinformation will fall under the bill\u2019s purview.<\/p>\n\n\n\n<p>Lesser offences involving disruption of <strong>public order or elections<\/strong> will carry a <strong>minimum sentence of 2 years<\/strong>, extendable to <strong>5 years<\/strong>, along with fines. Aiding or abetting such acts may also lead to <strong>two years of jail time<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Setting Up a New Regulatory Authority<\/h3>\n\n\n\n<p>The state plans to establish a dedicated <strong>Fake News on Social Media Regulatory Authority<\/strong> to monitor and act against misinformation.<\/p>\n\n\n\n<p>The Authority will include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Minister for Kannada and Culture (Chairperson)<\/li>\n\n\n\n<li>One MLA and one MLC<\/li>\n\n\n\n<li>Two social media representatives<\/li>\n\n\n\n<li>A senior IAS officer (Secretary)<\/li>\n<\/ul>\n\n\n\n<p>This Authority will also oversee content deemed <strong>abusive<\/strong>, <strong>obscene<\/strong>, or <strong>insulting to women<\/strong>, including anti-feminist posts and those <strong>disrespecting Sanatan symbols or promoting superstition<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">What Will Be Considered Fake News?<\/h3>\n\n\n\n<p>The bill defines <strong>misinformation<\/strong> as any <strong>false or misleading factual claim<\/strong> made intentionally or with <strong>reckless disregard<\/strong> for accuracy.<\/p>\n\n\n\n<p>Exceptions include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Opinions<\/strong><\/li>\n\n\n\n<li><strong>Satire<\/strong><\/li>\n\n\n\n<li><strong>Religious or philosophical speech<\/strong><\/li>\n\n\n\n<li><strong>Comedy or parody<\/strong>, if not presented as fact<\/li>\n<\/ul>\n\n\n\n<p>\u201cFake news\u201d covers <strong>manipulated media<\/strong>, <strong>misquotes<\/strong>, <strong>edited videos<\/strong>, or any <strong>fabricated narrative<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Special Courts and Swift Trials<\/h3>\n\n\n\n<p>To ensure <strong>speedy justice<\/strong>, the bill also proposes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Setting up <strong>special courts<\/strong><\/li>\n\n\n\n<li>Appointing <strong>dedicated public prosecutors<\/strong> for each court and High Court bench<\/li>\n<\/ul>\n\n\n\n<p>If passed, this legislation would be one of India\u2019s most comprehensive attempts to <strong>regulate digital misinformation<\/strong>, while addressing concerns about <strong>online abuse<\/strong>, <strong>women\u2019s safety<\/strong>, and <strong>freedom of expression<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n","protected":false},"excerpt":{"rendered":"<p>In a major step to curb digital misinformation, the Karnataka government is preparing to introduce the Karnataka Misinformation and Fake News (Prohibition) Bill, 2025.
