The decision came in response to an appeal by a <strong>Tamil Nadu police constable<\/strong>, who was unjustly <strong>denied consideration<\/strong> for promotion to sub-inspector.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1000\" height=\"465\" src=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/05\/Untitled-design-3-14.jpeg\" alt=\"\" class=\"wp-image-1294493\" srcset=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/05\/Untitled-design-3-14.jpeg 1000w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/05\/Untitled-design-3-14-300x140.jpeg 300w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/05\/Untitled-design-3-14-768x357.jpeg 768w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Background: A Long Wait for Justice<\/h3>\n\n\n\n<p>The appellant, appointed in <strong>March 2002<\/strong>, was eligible for consideration in <strong>2019<\/strong> under the <a href=\"https:\/\/www.ndtv.com\/india-news\/employee-has-no-right-to-be-promoted-but-considered-supreme-court-8314542#:~:text=The%20Supreme%20Court%20on%20Friday,considered%20for%20promotion%20unless%20disqualified.\">20% departmental quota<\/a> for in-service promotions. However, he was <strong>denied consideration<\/strong> on the basis of an old <strong>departmental punishment<\/strong>\u2014a postponement of increment for one year issued in <strong>May 2005<\/strong>.<\/p>\n\n\n\n<p>While he had faced both <strong>criminal<\/strong> and <strong>departmental proceedings<\/strong> for an alleged altercation with a colleague, he was <strong>acquitted<\/strong> in the criminal case and the departmental punishment was <strong>set aside in 2009<\/strong>.<\/p>\n\n\n\n<p>Despite this, the Superintendent of Police deemed him <strong>disentitled<\/strong> due to the 2005 penalty, which no longer stood legally.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Supreme Court\u2019s Verdict: Consider Him Without Delay<\/h3>\n\n\n\n<p>A bench of <strong>Justices Sudhanshu Dhulia and K Vinod Chandran<\/strong> ruled that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;An employee has no right to be promoted but has a right to be considered\u2026 which right has been impinged, unjustly, in the above case.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>The bench criticized the authorities for using a <strong>nullified punishment<\/strong> as grounds to deny promotion consideration and ordered that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The constable must be <strong>considered for promotion<\/strong> from 2019<\/li>\n\n\n\n<li>If found eligible, he must be <strong>promoted with retrospective effect<\/strong><\/li>\n\n\n\n<li>He is entitled to <strong>consequential benefits<\/strong>, including arrears<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">A Win for Service Rights &amp; Procedural Fairness<\/h3>\n\n\n\n<p>The apex court\u2019s ruling is seen as a <strong>landmark affirmation of procedural fairness<\/strong> in government employment. It underscores that <strong>past penalties<\/strong>, if legally overturned, cannot be used to deny career advancement.<\/p>\n\n\n\n<p>The court also <strong>overturned an October 2023 Madras High Court ruling<\/strong> that had dismissed the constable&#8217;s plea for consideration.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Broader Implication: Due Process Matters in Promotions<\/h3>\n\n\n\n<p>This ruling could have broader implications across government departments and public sector bodies.
