{"id":1290455,"date":"2025-02-07T12:36:01","date_gmt":"2025-02-07T07:06:01","guid":{"rendered":"https:\/\/trak.in\/stories\/?p=1290455"},"modified":"2025-02-07T12:36:33","modified_gmt":"2025-02-07T07:06:33","slug":"armed-forces-tribunal-stops-govt-from-denying-orop-benefits-to-pre-mature-retirees","status":"publish","type":"post","link":"https:\/\/trak.in\/stories\/armed-forces-tribunal-stops-govt-from-denying-orop-benefits-to-pre-mature-retirees\/","title":{"rendered":"Armed Forces Tribunal Stops Govt From Denying OROP Benefits To Pre-Mature Retirees"},"content":{"rendered":"\n<p>The government order that denied pre-mature retirees (PMR) One Rank One Pension (OROP) benefits was overturned by the primary bench of the Armed Forces Tribunal (AFT) in New Delhi, which ruled that it was unconstitutional.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"578\" src=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/02\/Screenshot-2025-02-07-at-12.35.14\u202fPM-1024x578.png\" alt=\"Armed Forces Tribunal Stops Govt From Denying OROP Benefits To Pre-Mature Retirees\" class=\"wp-image-1290468\" srcset=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/02\/Screenshot-2025-02-07-at-12.35.14\u202fPM-1024x578.png 1024w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/02\/Screenshot-2025-02-07-at-12.35.14\u202fPM-300x169.png 300w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/02\/Screenshot-2025-02-07-at-12.35.14\u202fPM-768x433.png 768w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2025\/02\/Screenshot-2025-02-07-at-12.35.14\u202fPM.png 1368w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>According to the AFT, the decision went against the Constitution&#8217;s Articles 14 and 16, which protect equality and equal opportunity in public employment.<\/p>\n\n\n\n<p><strong>OROP Benefits Overturned By Primary Bench of Armed Forces Tribunal<\/strong><\/p>\n\n\n\n<p>Judge Rajendra Menon and Rear Admiral Dhiren Vig (retd) gave the ruling on January 31 in <a href=\"https:\/\/indianexpress.com\/article\/cities\/chandigarh\/armed-forces-tribunal-strikes-policy-denying-orop-benefits-pre-mature-retirees-9816512\/\">response to petitions<\/a> by officers in the Army, Navy, and Air Force contesting the exclusion of PMR troops from OROP benefits.<\/p>\n\n\n\n<p>The affected officers fall into three categories:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Category A: PMR pensioners who retired before July 1, 2014, and already receive OROP.<\/li>\n\n\n\n<li>Category B: PMR pensioners who retired between July 1, 2014, and November 7, 2015.<\/li>\n\n\n\n<li>Category C: PMR pensioners who retired after November 7, 2015, and were denied OROP.<\/li>\n<\/ul>\n\n\n\n<p>Category C pensioners were the main target of the AFT decision.<\/p>\n\n\n\n<p>Under OROP, military personnel earned pension parity up to 1973, regardless of when they retired.<\/p>\n\n\n\n<p>Pension discrepancies resulted from the discontinuation of OROP by the Third Pay Commission in 1973.<\/p>\n\n\n\n<p><strong>Government Re-examined OROP<\/strong><\/p>\n\n\n\n<p>This discrepancy alarmed former service members, therefore the government re-examined OROP.<\/p>\n\n\n\n<p>The petitioners contended that no significant advancements were made in spite of the 5th and 6th Central Pay Commissions&#8217; (1987\u20132000) mentions of OROP.<\/p>\n\n\n\n<p>The government&#8217;s 2008 rejection of its 2004 pledge to adopt OROP sparked massive demonstrations.<\/p>\n\n\n\n<p>War veterans protested the denial of OROP compensation in 2009 by returning their medals.<\/p>\n\n\n\n<p>As a result, a 10-member parliamentary group known as the Koshiyari Committee was established, and it turned in its report in December 2011.<\/p>\n\n\n\n<p>The government&#8217;s plan to adopt OROP was revealed in 2014 by the defence and finance ministers at the time.<\/p>\n\n\n\n<p>In February 2014, the government announced that OROP would be implemented for the 2014\u20132015 fiscal year.<\/p>\n\n\n\n<p>The current government released a policy in November 2015 to put OROP into effect.<\/p>\n\n\n\n<p>Premature retirees who retired on or after July 1, 2014, were not eligible for OROP under this program.<\/p>\n\n\n\n<p>The petitioners contended that the exclusion of PMR employees was not addressed by a judicial commission that was established on December 14, 2015, to look into OROP irregularities.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.indiatoday.in\/india\/story\/one-rank-one-pension-completes-ten-years-analysing-the-expenditure-to-date-2629740-2024-11-07\">Image Source<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The government order that denied pre-mature retirees (PMR) One Rank One Pension (OROP) benefits was overturned by the primary bench of the Armed Forces Tribunal (AFT) in New Delhi, which ruled that it was unconstitutional.
