{"id":1284810,"date":"2024-08-30T11:34:40","date_gmt":"2024-08-30T06:04:40","guid":{"rendered":"https:\/\/trak.in\/stories\/?p=1284810"},"modified":"2024-08-30T11:42:29","modified_gmt":"2024-08-30T06:12:29","slug":"who-needs-tax-clearance-certificate-to-fly-abroad-govt-notice","status":"publish","type":"post","link":"https:\/\/trak.in\/stories\/who-needs-tax-clearance-certificate-to-fly-abroad-govt-notice\/","title":{"rendered":"Who Needs Tax Clearance Certificate To Fly Abroad, As Per Govt Clarification"},"content":{"rendered":"\n<p>In response to false rumors that required tax approval for anybody traveling outside, the Indian government released an explanation.<\/p>\n\n\n\n<p>Section 230 of the Income-tax Act, 1961 makes it clear that <a href=\"https:\/\/ddnews.gov.in\/en\/tax-clearance-certificate-to-fly-abroad-not-mandatory-for-all-govt-clarifies\/\">not everyone<\/a> requires a tax clearance certificate, according to the Central Board of Direct Taxes (CBDT).<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1000\" height=\"465\" src=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2024\/08\/ify-53.png\" alt=\"Who Needs Tax Clearance Certificate To Fly Abroad: Govt Notice\" class=\"wp-image-1284822\" srcset=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2024\/08\/ify-53.png 1000w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2024\/08\/ify-53-300x140.png 300w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2024\/08\/ify-53-768x357.png 768w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<p><strong>Tax Clearance Certificate to Fly Abroad Not Mandatory For All<\/strong><\/p>\n\n\n\n<p>The explanation comes in response to <a href=\"https:\/\/trak.in\/stories\/without-tax-clearance-certificate-you-cant-fly-out-of-india\/\">questions<\/a> posed following Finance Minister Nirmala Sitharaman&#8217;s July 23 Budget 2024\u201325 presentation.<\/p>\n\n\n\n<p>The budget suggested adding the Black Money Act of 2015 to the list of Acts for which a tax clearance certificate is required only after all responsibilities have been satisfied.<\/p>\n\n\n\n<p>According to the CBDT, the proposed modification does not mandate that all residents get a tax clearance certificate.<\/p>\n\n\n\n<p>The requirement is only applicable in certain situations where circumstances require such permission.<\/p>\n\n\n\n<p>These cases feature those with significant financial irregularities or those who owe more than Rs 10 lakh in unpaid direct tax arrears that have not been halted by any body.<\/p>\n\n\n\n<p>Approval from senior tax officials such as the Principal Chief Commissioner or Chief Commissioner of Income-tax is necessary to obtain a tax clearance certificate.<\/p>\n\n\n\n<p>The purpose of the explanation is to clear up any misunderstandings and reassure the public that the new tax clearance rules won&#8217;t hinder normal overseas travel.<\/p>\n\n\n\n<p>The Black Money Act, 2015 was added to the list by the government as part of its efforts to prevent tax evasion and guarantee that tax rules are followed.<\/p>\n\n\n\n<p><strong>What Does Section 230 Say?<\/strong><\/p>\n\n\n\n<p>The Income-tax Act, 1961, Section 230 does not require everyone to have a tax clearance certificate.
