{"id":1240565,"date":"2022-12-12T11:47:06","date_gmt":"2022-12-12T06:17:06","guid":{"rendered":"https:\/\/trak.in\/stories\/?p=1240565"},"modified":"2022-12-12T11:47:06","modified_gmt":"2022-12-12T06:17:06","slug":"termination-of-private-employees-illegal-if-industrial-disputes-act-not-followed-by-companies-minister","status":"publish","type":"post","link":"https:\/\/trak.in\/stories\/termination-of-private-employees-illegal-if-industrial-disputes-act-not-followed-by-companies-minister\/","title":{"rendered":"Termination Of Private Employees Illegal If Industrial Disputes Act Not Followed By Companies: Minister"},"content":{"rendered":"\n<p>Labour and Employment Minister Bhupender Yadav has said that any layoffs carried out by firms has to abide by the Industrial Disputes Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Context<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2022\/12\/Untitled-design-1-1-1280x720-1-1024x576-1.png\" alt=\"Termination Of Private Employees Illegal If Industrial Disputes Act Not Followed By Companies: Minister\" class=\"wp-image-1240590\" srcset=\"https:\/\/trak.in\/stories\/wp-content\/uploads\/2022\/12\/Untitled-design-1-1-1280x720-1-1024x576-1.png 1024w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2022\/12\/Untitled-design-1-1-1280x720-1-1024x576-1-300x169.png 300w, https:\/\/trak.in\/stories\/wp-content\/uploads\/2022\/12\/Untitled-design-1-1-1280x720-1-1024x576-1-768x432.png 768w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>The minister was answering a question about whether the government has taken <a href=\"https:\/\/www.hindustantimes.com\/india-news\/lay-offs-if-not-carried-as-per-industrial-disputes-act-are-deemed-illegal-minister-yadav-101670498933471-amp.html?utm_campaign=fullarticle&amp;utm_medium=referral&amp;utm_source=inshorts\">cognizance<\/a> of the mass layoffs in various MNCs and Indian companies in the IT, social media, Edu Tech firms and related sectors.<\/p>\n\n\n\n<p>The provisions of the Industrial Disputes Act, 1947 (ID Act) cover matters relating to layoffs and retrenchment in industrial establishments.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What the law says<\/strong><\/h2>\n\n\n\n<p>As per this act, firms that employ 100 or more people have to seek prior permission before carrying out closure, retrenchment or lay-off.<\/p>\n\n\n\n<p>&#8220;Further, any retrenchment and lay-off are deemed to be illegal which is not carried out as per the provisions of the ID Act.&nbsp;<\/p>\n\n\n\n<p>The ID Act also provides for the right of workmen laid off and retrenched for compensation and it also contains provision for re-employment of retrenched workmen,&#8221; said Yadav.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Who holds the right of enforcement?<\/strong><\/h2>\n\n\n\n<p>Based on their respective jurisdictions as laid out in the ID Act, Central and State Governments take actions to address the issues of the workmen and protect their interests.<\/p>\n\n\n\n<p>The jurisdiction in the matters with regard to multi-national and Indian companies in the IT, social media, Edu Tech firms and related sectors, in this case, lie with the respective state governments.<\/p>\n\n\n\n<p>The minister <a href=\"https:\/\/www.hindustantimes.com\/india-news\/lay-offs-if-not-carried-as-per-industrial-disputes-act-are-deemed-illegal-minister-yadav-101670498933471-amp.html?utm_campaign=fullarticle&amp;utm_medium=referral&amp;utm_source=inshorts\">also <\/a>informed that no data is maintained at the Central level on laying off and retrenchment with reference to these sectors.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Labour and Employment Minister Bhupender Yadav has said that any layoffs carried out by firms has to abide by the Industrial Disputes Act.
