New Cyber Cafe Rules in India!

The Ministry of Information Technology have come out with Fresh Guidelines and Amendments for Cyber Cafe’s in India – And it seems that Govt. is getting quite severe with what and how the data is consumed in Cyber Cafe’s.

In last couple of years there have been many instances where Cyber Cafe’s have been a safe haven to carry out illegal activities – most of which have been for acts of terrorism. The fresh guidelines released by the ministry clearly puts in place rules & regulations to put brakes on such incidences.

Additionally, Cyber Cafe’s is have been favorite joints to view pornography – Going forward, it will be illegal to view pornography in Cyber Cafes!

Here are some of the important points released in the amendments to IT Technology Act. (I have simplified the language for benefit of readers in some cases)

Identification of User

Every member will have give an identification – If he does not have one – Cyber Cafe owner will have take a digital picture using a Webcam. And the log register will have information about every individual visiting the cyber cafe. Those who refuse to give any form of identity, will not be allowed inside the Cyber Cafe

Log Register

Every Cyber Cafe will have a Date-wise Log register of all the cyber cafe visitors – The owner will have to submit a hard and soft copy of the same to the person or agency as directed by the licencing agency by 5th day of next month.

The Cyber Cafe Owner needs to log the following:

  • History of websites accessed using computer resource at cyber cafe
  • Logs of proxy server installed at cyber café
  • Mail server logs
  • Logs of network devices such as router, switches, systems etc. installed
    at cyber café
  • Logs of firewall or Intrusion Prevention/Detection systems, if installed.

Physical Layout of Cyber Cafe

Partitions of Cubicles inside the Cyber Café should not exceed four and half feet in height from the floor level. The screen of all computers shall face the common open space of the Cyber Café.

Minors are not allowed to access any computers in Cyber Cafe unless they are accompanied by guardians or parents!

Pornography / illegal Content Access

Cyber Cafe owner must ensure that all the computers are equipped with
safety / filtering software so as to the avoid access to the websites relating to
pornography, obscenity, terrorism and other objectionable materials. Cyber Café shall take sufficient precautions to ensure that their computer resource are not utilized for any illegal activity.

Cyber Café shall display a board, clearly visible to the users, prohibiting
them from viewing pornographic sites.
Cyber Café shall incorporate sufficient preventive measures to disallow the user from tampering with the computer system settings.

To be honest with you I am not sure how many of these guidelines will be followed, but I do feel that these strict guidelines are needed given that anti-social elements have been using it as their back yard!

    I dont understand why govt. try To stop pornography through cyber cafes whereas govt. can ban these sites from airing in internet in india. If porn sites dont appear on internet then no one can browse through it. it will be a full stop. It will be harsh on cyber cafe owner to say to buy softwares that will filter websites to stop pornographic.

    I object that a cyber cafe owner cannot scan or photocopy the ID provided.
    First of all i am a cyber cafe owner and my business is located in Ahmedabad.

    Mr Rahman Do you know how much risky it is to run a cuber cafe.
    Have you raised this question to any of the cyber cafe owner ?

    well let me explain you

    You come at my business to use my PC you show me your ID proof.

    Now here comes the situation

    First of all you I dont know you which to me stands for (I am not aware of you, your family background and you are a completely unknown person to me). so i will need something to recognize you when police comes at my door to see the logs i will have to show them your image and that is what they demand all the time.

    The technology has developed so rapidly that i can edit my license with a different name get a print out on a glossy paper or a card printer and laminate it. If i will show that to you , I bet you wont be able to detect that is it a dummy or a original one. Even small kids can use Photoshop or MS paint now a days i guess you know that.

    Police checks in every 2 weeks to see the logs and it is clearly mentioned that one should have a CCTV or an Image proof of the one who uses computer.

    You pay me what 15-20 Bucks to use my PC for an hour ? Do you think that i am insane to install 10-11k CCTV systems and Scanners to manage logs and documents.
    there is no profit in this business and its just a risk now a days to open a cyber cafe.

    Police comes to my cafe every now and then but when they come i show them

    1) Which website users open.
    2) Is my filter successful to ban porn and terrorism and any other such websites ( I have to show them a live demonstration).
    3) Are my CCTV systems recording the logs perfectly.
    4) And the most of all am i keeping a copy of the proof shown.

    and its due to this i can keep my business open because if i am found guilty for any of the above the hard earned money by me will go to penalty and nothing else.

    I have talked to police department over the issue and they have allowed me to scan the images but one thing off course i keep my data in a secure format and also i provide in written when asked by people like you that
    “your ID is safe with us and wont be used any further.”

    Its just easy to say few things but ask people like us that how difficult it is.

    Its just because of notorious users we have to suffer by paying penalty or end up in jail.

    When it comes to Illegal activities, it is easy as poop to create a fake ID if to be used in a cyber cafe, so this will only create problems. About those who do access porn sites, is there a punishment, or not. If there is, its idiotic. And if there isn't, what the point of creating such an oppressive law only to create probs for people.

    the rules and regulations of cyber cafe are some what better but some cyber cafe who have the zerox machines are taking the zerox of the identity proof but not taking the photos by the web cam\
    if the zerox identity falls into the some one hands they may take the CELL PHONE SIMS basing on that proof it may effect the people. such ownerrs should be punished .

    This is useless. Terrorists will do it anyway (even by hacking network or wifi (which was happened in mumbai case) & innocent people will be punished.

    Once I went to cyber cafe the guy there asked me for license. He told me that he will note down my license no in his register & will return my license in my cabin while I was leaving the cyber cafe I saw my license scanned in his system. I asked him why he had scanned my license without asking me. He answered that he is required to do so by laws. I told him that if he want to note down my license no then its enough but I won’t allow him to keep my license in his system. I forced him to delete & he did so in front of me.

    Govt. made necessary to submit ID proofs but have not published advisory for privacy of customer data for cyber cafes. Customers should have privacy for their data. In current rules / laws there is no such provision & peoples’ data can be easily misused by cyber cafe owners.

      You have raised a very important point about user privacy – and I had really not thought on those lines. But now you raise it, I agree that it is a concern. Who will ensure that the details that Cyber Cafe owner takes from users will not be shared with anyone. What happens if all these details fall in the wrong hands…I shudder to think.

      Let me try and dig out something on this…

      Yes u r rit all da data of scanned are stored in drive D and it can be used easily by other network for misuse there is no other extra device or hard drive for these works

    Last week I visited a netcafe to print a document. He asked me to register and explained to me that it has now become mandatory. I was apprehensive when the registration process is more stringent than many govt office registrations e.g. property sale or bank account opening etc.
    Actually I can get on to the net at home and only visited the internet cafe to print a document as I dont have a printer at home.
    Going by the efficiency of the govt departments, I am not convinced as to how the data collected will be used by them.
    How efficient the registration process is to be seen. The details noted by them are Name, address, mobile no., ID proof and a latest pic. If people with evil intent beat around the system by using lost IDs with fake details, innocents will suffer.

    Regarding the present set of rules says that watching porno or adult programmes in ‘Public places’ is a crime. (I remember a news item recently where police raided a resort and arrested govt officers watching an adult dances. The officers argued that they have arranged the same in private so it is not a crime and came out clean) May be this prohibition of ‘watching porno in cybercafe’ falls under public places catagory.

    Now I have a doubt. OK agreed that by these excersizes, the people visiting cafes can be monitered. Now what if some cafe owner does something illegal in his cafe by using the username, passowrds of innocent people? Dont say it is not possible. We are watching news in TV where some people dupe innocents at ATMs. What if same thing happens where the owner uses the ID of some user who rarely visits the place? They have access to such details (some times they help people in registering)
