Employee Provident Fund Eligibility

Every Employee in India should have an Employee Provident Fund if He / She has a salary above Rs. 6500/-. If the Employer does not have it, the employee has right to ask for EPF in his name. Generally, Employer has to pay the equivalent amount for EPF as much as the employee pays.

The employer shall pay the contribution payable to the EPF, EDLI and Employees’ Pension Fund in respect of the member of the Employees’ Pension Fund employed by him directly by or through a contractor.

The government will continue to contribute 1.16% up to the actual wage of maximum Rs.6500 per month towards Employees’ Pension Scheme.  The employer’s share in the Pension Scheme will be Rs.541.

Under Employees’ Deposit-Linked Insurance Scheme the contribution @ 0.50% is required to be paid up to a maximum limit of Rs. 6500.

Who is Eligible for Employee Provident Fund?

For New Entrants:

  • An employee is eligible for membership from the day he joins the company who has enrolled for EPF Scheme
  • If an Employer has equal to or more than 20 employees, it is mandatory for him or to join the Employee Provident Fund Scheme.
  • If the employee’s emoluments exceed Rs. 6,500/- per month, he has the option to join the Scheme(s)  with the consent of the employer.
  • Declare previous employment details, if any, in  Form No. 11  to the employer.
  • On becoming a member of the Schemes file details in Form No. 2 ( family particulars/ nominations) through the employer.
  • The rate of contribution payable by a member shall be @ 12% of his emoluments.
  • A member can contribute statutorily over and above the prescribed rate.

For Existing Members:

  • Enrollment:
  • Any change in the family status, such as, –
    • the marriage of the member.
    • Additions/deletion in the family.
    • Legal adoption of the children.
    • Change of nominee is to be filed in Form No. 2 through the employer.
  • In the event the member is holding a Scheme Certificate (under EPS, 95), he should surrender the same to the concerned EPFO office, through his employer.
  • A member is entitled to various benefits & facilities such as withdrawals, advances, pensions, death insurance etc.

New Scheme for Dormant Accounts

Did you know that as of the last financial year Rs 26,496 crore of PF money was with the Employees’ Provident Fund Organisation (EPFO) in inoperative accounts? Now, the EPFO has asked field offices to identify the beneficiaries of inoperative PF accounts and settle those by making payments or transferring money to their active accounts. To quicken the process, EPFO has an online help desk.

This new facility is meant to help members trace their PF numbers or find the total fund accumulated. The biggest problem with subscribers is that they don’t remember their account numbers, said financial planners.

You just need to login to website www.epfindia.com – Under the section ‘for employees’, click on link ‘Inoperative A/C Helpdesk System’. First, the subscriber needs to key in the problem he or she is facing and then fill details such as the name of the employer, date of joining and leaving the company, personal details and so on. Once these are done, you will receive a reference number. You need to keep this reference number.

The EPFO officers will then get in touch with you to verify. After verification, you will be able to transfer your PF balance into your account.

    I am working in a Semi – Govt. Unit working under NGO Management. Our Unit was with FPAI, an NGO from 1983 to 2003. Our Unit was shifted to another NGO from 2003. We were not paid with any PF or Gratuity for our services in FPAI. Now, we have filed a case WITH Regional Labour Commissioner for Gratuity for our services with FPAI which favoured us and we have got Gratuity arrears with interest. Now we would like to claim PF arrears also. What is the proceedure? Our salaries (which was above Rs.6,500/- ) were not deducted with PF amount despite our written requisitions during our stay with FPAI. Kindly guide us and help us to claim the PF arrears with interest.

    Hi , i was a teacher in pvt school in 2011and every month Pf was deducted from my salary, i left the job in 2012. In 2013 i filled up the form for my Pf , form 19 c has been settled acc to pf office but form 10 c has been rejected. When i chk the status online on epf site under member portal , it is showing that the opening balance till 31/3/2012 is 0.in 4,5&6 month the pf has been submitted by the school (only 3 month) and that too after leaving my job , i left the job on 15 may 2012 . Is this thing is right? Is it allowed to submit the pf this much late?     EPF Challan consists of 25.61 % and the classification is as follows.

    Exp. if you are earning 6500/- per month , the deduction of provident fund from your salary will be as
    Rs.780/- (12% on Rs.6500/-)

    1. 12% on Rs. 6500/- it comes to Rs. 780/- (your contribution ) A/c.

    2. 12% of employer’s contribution consist of 8.33 % and 3.67%

    a) 8.33 % goes to EPS ( Subject to maximun Rs.541/-) and rest will go to EPF

    b) 3.67 % goes to EPF

    3. 0.5 % Employees Direct Linked Insurance Scheme (A/c No.21)

    4.Administrative Charges:

    1.10% of emoluments = Provident Fund (A/c No.2)

    0.01% of emoluments = EDLIS (A/c No.22)

    Grand Total (12% + 12.5% +1.11 %) i.e. 25.61%

      As they do not meet the eligibility of this scheme.

    I am currently working in an MNC for the last 4 years. However irrespective of our salary hike our PF deduction always remains 780 per month which is around 2% of my basic component. Moreover this amount ie., 780/- per month is fixed for everyone irrespective of their salary. I have an understanding that companies who are registered in India need to have their employees registered with the EPF but I do not know how they have fixed this amount for everyone.

    Kindly let me know if there is any particular clause under the EPF section which allows companies to fix their PF contributions of tehir employees.

    1)I dont understand the funda of Rs.6500/- means those people have salary above Rs.6500/- they become that much rich that they do not have to contribute with EPF or in the view of employers we can say that above Rs.6500/- is much better salary that people can easily save money. City like mumbai normal family ( husband and wife and two childrens ) want at least, minimum Rs.10 to 12 Thousand without saving so do not understand criteria of Rs.6500/- 2) Those company have at least 20 employee those only eligible for EPF here please explain me those who r doing work with small firm or offices had they done any sin or this government is not with them or they r just voters and tax payers for Government if we eligible for tax and voting then for EPF too I have some other problem that some companies open their sister concern and shift name of their staff in this condition mejority of staff get reduce and due the same these firm r not eligible for EPF is there any control of Government on such type of firm. And last, Government body like shops and establishment also not work properly (I don’t want to explain here) that every body knows better.

    Better deduct pf or vpf as much as possible . I have seen people whose pf amount get increase by 10k or more every month apart from their contribution.So at somepoint of time when your pf amount increase you will get more n more interests, so someday you will be getting 50k interest from your pf and you can enjoy your salary without thinking about savings.
    Better contribute your pf n vpf all your basic salary n try to survive with salary left over after basic. If you can earn that much to manage then you will not have to think about your future, you will get a stable planned savings for your future.

    I left 15.08.2009.

    I, worked in Hyderabad one year, In My company people cut my salary monthly(Rs: 1680) as PF,we asked many times to provide pf account number, but they haven’t provide those details, when i resigned my job , asked them to give my pf details or give to me money back, they are not giving proper response, we found that, till the time the company didn’t open any pf account, but they are detection my amount nearly (Rs:12000) , what should i do? could we have any office to give the compliant , please send me the those details,

    We have 19 members shortly one more addition would be there to our strength. All the 20 employees would be having Basic salary more than Rs. 6500/-. As per provisions of PF Scheme as soon as we have 20 members we have to take PF Registration No. None of the employees are interested in joining PF scheme. In such cases it is advised that we need to take declaration in Form No. 11. As per Form No. 11 it is just the declaration of earlier employment. It nowhere states that he is willing / not willing to join the PF. Can somebody guide as to whether we need to have PF deduction from all members or not.

    I want to know what is the minimum Basic + DA limit on which PF must be deducted by employer. I mean if an employee has Basic Salary of Rs 1800/- + DA Rs 450/- + Other allowances Rs 2600/- (Total salary Rs 4850/-) then PF will be deducted on Rs 2250/- right or wrong ? Is deducting PF on s 2250/- as per the law or we should deduct the PF on some other minimum level ?

      If your company has 20 or more employees, whereas 5 and more for Cinema Theaters, then you are eligible for EPF, if your basic salary exceeds 2500/- and above.
      12% from total of Basic salary(sealing max. rs.6500/-) + DA

This means that an employee is eligible for PF only if he/she has a salary above Rs6500/-. Is this correct? Is an employee, whose salary is below Rs6500/-, not eligible for EPF?

      if your salary is more than 6500 p.m … then your employer is restricted to only 12% on amount of limit 6500 pm… so it comes 780.. so deposited amount of your employer is absolutely correct…
